Terms and Conditions of Booking – Training Courses

1.    All bookings for training courses run by Tamworth Sailing Club must be made via our online bookings system.  Bookings are only confirmed once full payment is received.  Your reservation may be lost if you do not make payment in full on completion of the online booking.

2.    Our preferred payment method for training course bookings is via our online payments gateway, PayPal.  You can make payment using a debit or credit card or using your PayPal account.  This is the safest way to ensure your payment is received at the time of booking.  Payments can also be made via BACS, Cash or Cheque presented to the training principal or via our direct debit gateway (you must have previously signed up for this method as a club member).

3.    Payment for any training course must be made in full, no part payments are permitted.

4.    Tamworth Sailing Club reserve the right to cancel any course reservation where payment has not been made in full within 7 days of booking.

5.    Attendance on any training course does not guarantee a certificate of competence on completion.  All learners must meet pre-determined standards of competence, as stipulated by the RYA, prior to any certificate being issued.  Our instructors are dedicated to ensuring the needs of every learner are met and will work with you as far as practicable to ensure your success in the qualification.

6.    For any junior training courses, a parent, guardian or nominated adult must remain in attendance for the duration of the training.

7.    Although many of our training courses are open to non-members we reserve the right to honour bookings from members of Tamworth Sailing Club as priority along with bookings that are made as a direct progression from a current training programme. E.g. Students attending a RYA Level 1 programme will be prioritised places for RYA Level 2.

8.    Training courses delivered by Tamworth Sailing Club are exempt from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, previously the Distance Selling Regulations 2000, due to the nature of our leisure-based training courses for which cancelled course bookings are difficult to refill at short notice. We do however operate a goodwill cancellation policy as below.

9.    The refund of any fees paid under these terms and conditions will only be made to the same card or payment method used to book the original training course.

Changes and Cancellations by You

10.    All confirmed bookings where full payment has been received will be subject to our cancellation policy as below:

a)    Any booking for which cancellation is made more than 30 days before the course start date will receive a full refund or may transfer their booking to any future booking at no additional cost if suitable opportunity exists within the calendar year.
b)    Cancellation of a booking between 30 and 14 days prior to start date will incur a charge of 50% of full fee. This is due to the fact we will be unlikely to fill you place within this timescale.  You may transfer the refundable amount to a future training course if a suitable opportunity exists. 
c)    Cancellation of a booking within 14 days of course start date will result in loss of full fee.  Within this timescale our resources will have been confirmed and we will not be able to fill your place and hence the club will incur unrecoverable costs.

11.    Notwithstanding the above we will aim to fill all cancelled bookings.  If your cancelled place can be filled by another applicant, we will offer you a full refund or transfer to another suitable course (if available within the calendar year).

12.    No refund is payable for any course after it has started.

13.    No partial refund will be made for partial attended training courses where the learner has been unable to make certain sessions.

14.    Membership fees bundled with training course fees are non-refundable.

15.    Any request to cancel a booking must be made to the Training Principal via email stating the reason for cancellation.  You will receive confirmation of cancellation and the appropriate refund made within 14 days if due.  The date of this email will serve as the notification start date for calculation of any refunds due.

Changes and Cancellations by Tamworth Sailing Club

16.    Tamworth Sailing Club endeavours to run all courses advertised on our website.  However, if a training course is not viable due to low number of learners we reserve the right to cancel the course. Should we cancel a course we will try in the first instance to accommodate you on an alternative, equivalent course. If this does not suit you, you will receive a full refund of the course fee.

17.    In the event of adverse weather or other factors beyond our control which in the opinion of Tamworth Sailing Club are dangerous and/or unsuitable conditions for the activity:

a)    Taster session – we will try in the first instance to accommodate you on an alternative, equivalent taster session. If this does not suit you, you will receive a full refund of any fees paid to Tamworth Sailing Club.
b)    Training course session – we will provide relevant on-shore training activity or if this is not possible we will seek to reschedule the training session to complete the course. No course fee refund will be made.
c)    Full training course - where a whole course is cancelled we will try in the first instance to accommodate you on an alternative, equivalent course. If this does not suit you, you will receive a full refund of the course fee.

18.    Any refunds made for any of the above situations will only include monies paid directly to Tamworth Sailing Club and does not include any payment to Kingsbury Water Park for park entrance fees unless specified in the course description or joining instructions.

19.    We reserve the right to remove from any course, students that fail to comply with our standard practices and procedures. We reserve the right to refuse enrolments and/or suggest alternative arrangements if we believe that it will not be in the best interests of other participants and/or the individual concerned to be enrolled on one of our courses.

Declaration

I declare that to the best of my knowledge, I am fit to participate in the above course and confident in the water.

Illness or medical conditions need not necessarily prevent a student taking part in the course, which can be strenuous and wet, but it is clearly in everyone's interest that instructors are aware of any potential problem. Please make your instructor aware of any medical conditions or treatment you believe is relevant to your enjoyment and safety during the training event (e.g. inhaler etc.)

The club is indemnified for £5,000,000 however our insurers require that we include the following disclaimers.

a)    The RYA, the principal, RYA senior instructors, RYA instructors, assistant instructors do not accept responsibility for any loss, damage, or injury suffered by persons and / or their property arising out of or during their activities whilst training and/or coaching and/or instructing unless such loss or damage was caused by or resulted from their negligence, or deliberate act.

b)    Neither the club or the RYA will be responsible for any damage to or loss of property belonging to members, their guests, or visitors, nor will the club accept liability for personal injury sustained by members, their guests, or visitors arising out of the use of the club premises, the club boats (or any other facilities provided by the club) or participation in any event organised by the club, whether or not such damage shall be occasioned by neglect, default or negligence of any of them, the officers, committee or servants of the club.
